Welcome to Consultativ. These Terms of Use ("Terms") govern your access to and use of consultativ.com and related pages, forms, assessments, resources, communications, and other online services that link to these Terms (collectively, the "Site").
The Site is operated by Consultativ LLC, doing business as Consultativ ("Consultativ," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Any paid consulting, advisory, diagnostic, or client services are governed by a separate written agreement between you and Consultativ. For information about how we handle personal information, please review our Privacy Policy.
Consultativ provides advisory, consulting, and related services in areas that may include AI transformation, Company Brain architecture, knowledge management, workflow design, process mapping, subject matter expert knowledge capture, AI readiness assessment, agent-ready operations, digital transformation, and organizational change.
The content on the Site is provided for general informational and business development purposes. It does not create a client relationship, consulting engagement, or professional services relationship between you and Consultativ. A client relationship is created only when both parties enter into a separate written agreement.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

You may view, download, or print a reasonable amount of Site Content for your internal business review, provided that you do not modify the content, remove proprietary notices, present the content as your own, sell or distribute it externally, or use it to create a competing product or service.
The name Consultativ, our logos, service names, taglines, and related branding are trademarks or trade names of Consultativ. You may not use our name, branding, or trademarks in any way that suggests endorsement, partnership, or affiliation without our prior written permission.
The Site may offer assessments, scorecards, guides, diagnostic tools, and other resources. These materials are provided for general informational purposes only. They are not a substitute for a formal consulting engagement, legal review, compliance assessment, or professional advice tailored to your organization. Any score or recommendation from an assessment is preliminary and should not be treated as a guarantee of any outcome.
Consultativ may publish content related to AI transformation, AI readiness, Company Brain architecture, agent-ready workflows, and related topics. This content is provided for general business and educational purposes. It does not constitute legal, regulatory, compliance, technical, financial, or other professional advice.
AI-related outcomes depend on many factors including your organization's data, systems, workflows, governance, technology stack, and team adoption. We do not guarantee that any AI initiative, diagnostic, or related service will produce any specific financial result or operational outcome. Any examples, use cases, or projected outcomes on the Site are illustrative unless expressly identified as actual client results.
Paid services provided by Consultativ are governed by separate written agreements. If there is a conflict between these Terms and a signed client agreement, the signed client agreement will control for the relevant services. Client deliverables, ownership rights, confidentiality obligations, payment terms, and liability limitations will be addressed in the applicable client agreement.
If you submit information through the Site, you represent that you have the right to provide that information. You agree not to submit information you do not have the right to share, information that violates another person's rights, or information that contains malicious code or confidential third-party information without authorization. Submitting information through the Site does not create a client relationship unless we enter into a separate written agreement.
You should not submit highly confidential, sensitive, regulated, or proprietary information through general website forms unless we have agreed to receive that information through an appropriate secure channel. Information submitted through public or general Site forms is not treated as confidential client information unless and until a separate written agreement applies.
The Site may include links to third-party websites, tools, platforms, forms, scheduling systems, analytics tools, or other services. We are not responsible for third-party websites, tools, services, content, privacy practices, or security practices. Your use of third-party services is governed by their own terms and privacy policies.
The Site Content is provided for general informational purposes only. Nothing on the Site should be interpreted as legal, regulatory, compliance, tax, accounting, investment, cybersecurity, technical, employment, or other regulated professional advice. To the fullest extent permitted by law, Consultativ and its owners, officers, employees, contractors, advisors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Site or Site Content. To the fullest extent permitted by law, Consultativ's total liability for any claim arising out of or relating to the Site or these Terms will not exceed $100 or the amount you paid to Consultativ for access to the relevant Site feature, whichever is greater. This limitation does not apply where prohibited by law.
You agree to indemnify, defend, and hold harmless Consultativ and its owners, officers, employees, contractors, advisors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, information you submit through the Site, or your violation of any law or third-party right.

Please include your contact information, a description of the work you believe has been infringed, a description of the allegedly infringing material, a statement that you have a good-faith belief the use is not authorized, and your physical or electronic signature.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought in the state or federal courts located in Florida, unless otherwise required by applicable law.
